1. Who these Terms apply to

These Terms apply when you access or use FomoDejavu, including its calculators, articles, guides, visuals, saved-scenario features, share links, search tools, pages, and related services.

References to “FomoDejavu”, “we”, “us”, and “our” mean the operator of the FomoDejavu website. References to “you” mean the person or organization using the site.

2. Educational use only

FomoDejavu provides educational finance content and historical examples. The site is not a bank, broker, adviser, exchange, insurance provider, tax adviser, legal adviser, or accounting adviser.

Nothing on the site is personalized advice, a recommendation, a solicitation, an offer, or a guarantee. Your decisions remain your responsibility.

• Do not treat calculator outputs as financial advice or a prediction of future results.
• Do not rely on the site as your only source for tax, legal, accounting, investment, compliance, or risk decisions.
• Talk to a qualified professional before making decisions that matter to your money, taxes, legal position, or business.

3. Eligibility and responsible use

You may use the site only if you can follow these Terms and applicable law. The site is intended for general educational use and should be used by minors only with appropriate parent, guardian, or school supervision.

• Use the site only for lawful purposes.
• Do not submit sensitive personal, financial, health, credential, account, or regulated information unless a feature clearly asks for it and you understand why it is needed.
• Do not impersonate another person, misrepresent your relationship with an organization, or use the site to deceive others.
• Do not use outputs from the site as if they were certified, audited, or professional advice.

4. Accounts, saved scenarios, and local browser storage

Most FomoDejavu features do not require an account. If the site later adds accounts, paid plans, newsletters, or other registered features, extra terms or notices may apply.

Some features, such as saved scenarios, may store information in your browser on your device. If you clear browser data, change devices, or use private browsing, those saved items may be lost.

• You are responsible for checking what is included in a saved or shared scenario before you send it to anyone.
• A shared link may reveal the scenario inputs included in the link to anyone who receives or accesses it.
• Do not include private or sensitive information in scenario names, notes, URLs, or messages unless you are comfortable sharing it.

5. Acceptable use and security

You agree not to misuse the site or interfere with the service, data sources, users, infrastructure, or security controls.

• Do not attempt unauthorized access, probing, scanning, credential attacks, scraping that overloads the site, denial-of-service activity, malware delivery, or security bypasses.
• Do not copy, frame, mirror, or republish large parts of the site in a way that confuses users, violates intellectual property rights, or competes unfairly with the original site.
• Do not use the site to create misleading, harmful, unlawful, defamatory, discriminatory, or spam content.
• If you find a security issue, please report it responsibly to hello@fomodejavu.com and do not exploit, disclose, or access data beyond what is necessary to demonstrate the issue safely.

6. Data, calculations, and third-party sources

FomoDejavu may use market data, inflation data, real-estate examples, external references, APIs, libraries, hosting providers, analytics tools, advertising tools, and other third-party services.

Data and calculations may be delayed, estimated, incomplete, revised, normalized, or unavailable. Different sources may use different methods or corrections.

• Historical examples do not guarantee future outcomes.
• Backtests and what-if scenarios are simplified illustrations.
• Important figures should be verified against authoritative sources before you rely on them.
• Third-party websites and providers have their own terms, privacy notices, security practices, and availability risks.

7. Privacy, cookies, and data protection rights

Our Privacy & Cookies page explains what information we collect, why we collect it, how cookies and local storage may be used, how long information may be kept, and how to contact us about privacy requests.

These Terms are intended to work with privacy principles such as transparency, purpose limitation, data minimization, security safeguards, access, correction, deletion where applicable, and accountable handling of personal information.

Depending on where you live, laws such as the GDPR, KVKK, PIPEDA, or other privacy laws may give you rights that cannot be waived by contract. Nothing in these Terms is intended to remove those mandatory rights.

• If there is a conflict between these Terms and a mandatory privacy right that applies to you, the mandatory legal right controls to that extent.

8. Intellectual property

The site design, text, visual presentation, logos, original graphics, software elements, compilations, and other materials may be protected by copyright, trademark, database, and other laws.

You may link to public pages and use short excerpts for fair quotation, commentary, education, or review, as long as you give appropriate credit and do not mislead people about the source.

• Do not remove attribution, copyright notices, disclaimers, or source context from copied material.
• Do not use FomoDejavu branding in a way that suggests sponsorship, approval, or partnership unless we agree in writing.
• Third-party data, trademarks, and content remain the property of their respective owners.

9. User messages, feedback, and submissions

If you send feedback, corrections, bug reports, ideas, or other messages, you give us permission to review them, respond to them, and use them to improve the site without owing compensation.

Please do not send confidential, proprietary, or highly sensitive information unless we have a separate written agreement that covers it.

10. Ads, affiliates, and third-party offers

The site may show ads, affiliate links, sponsored references, or third-party offers. Where a material commercial relationship exists, we aim to disclose it clearly.

We are not responsible for third-party products, services, claims, pricing, eligibility rules, availability, or decisions. You should review third-party terms and policies before using an offer.

To the fullest extent permitted by applicable law, FomoDejavu and its operators, contributors, reviewers, service providers, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages, or for lost profits, lost opportunities, lost data, business interruption, trading losses, tax costs, or decisions made from site content.

• Some jurisdictions do not allow certain warranty exclusions or liability limits. In those places, the exclusions and limits apply only to the maximum extent permitted by law.
• Nothing in these Terms excludes liability that cannot legally be excluded.

13. Governing law and dispute handling

Unless mandatory local law gives you rights that cannot be changed by contract, these Terms are governed by the laws of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules.
